Representative Mulder moved and asked unanimous consent that CSHB 52(FIN) am be returned to second reading for the specific purpose of considering Amendment No. 3. Amendment No. 3 was offered by Representative Mulder: Page 1, line 5: Delete "$26,369,400" Insert "$20,335,700" Page 3, following line 25: Insert new bill sections to read: "* Sec. 2. UNALLOCATED REDUCTIONS. (a) Except for the appropriations identified in (b) of this section, the amounts appropriated from the general fund for the fiscal year 2001 operating expenses of the executive branch as contained in the Conference Committee Substitute for HB 312 and enacted into law are reduced by 1.125 percent. This reduction is an unallocated reduction of the amounts appropriated from the general fund, and the Office of the Governor, office of management and budget, shall allocate the reduction among the appropriations for the fiscal year 2001 operating expenses of the agencies of the executive branch. 2000-04-30 House Journal Page 3676 HB 52 (b) The following appropriations contained in Conference Committee Substitute for HB 312 are not subject to the unallocated reduction imposed by (a) of this section: (1) that portion of the appropriation made to the Department of Administration for Alaska longevity programs management that is allocated for Pioneers' Homes; (2) those portions of the appropriation made to the Department of Corrections for administration and operations that are allocated for the Anvil Mountain Correctional Center, Combined Hiland Mountain Correctional Center, Cook Inlet Correctional Center, Fairbanks Correctional Center, Ketchikan Correctional Center, Lemon Creek Correctional Center, Matanuska-Susitna Correctional Center, Palmer Correctional Center, Sixth Avenue Correctional Center, Spring Creek Correctional Center, Wildwood Correctional Center, Yukon- Kuskokwim Correctional Center, and community jails; (3) the appropriation made to the Department of Corrections for community residential centers; (4) the appropriation made to the Department of Corrections for out-of-state contractual; (5) the appropriation made to the Department of Corrections for the Point MacKenzie rehabilitation program; (6) the appropriation made to the Department of Education and Early Development for the Mt. Edgecumbe Boarding School; (7) those portions of the appropriation made to the Department of Health and Social Services for juvenile justice that are allocated for the McLaughlin Youth Center, Fairbanks Youth Facility, Nome Youth Facility, Johnson Youth Center, Bethel Youth Facility, Matanuska-Susitna Youth Facility, and Ketchikan Regional Youth Facility; (8) that portion of the appropriation made to the Department of Health and Social Services for institutions and administration that is allocated for the Alaska Psychiatric Institute; (9) that portion of the appropriation made to the Department of Military and Veterans Affairs for the Alaska National Guard that is allocated for the Alaska Military Youth Academy; (10) the appropriation made to the University of Alaska. (c) The amounts appropriated from the general fund for the fiscal year 2001 operating expenses of the legislative branch as contained in the Conference Committee Substitute for HB312 and enacted into law are reduced by 1.125 percent. This reduction is an unallocated reduction of the amount appropriated from the general fund to the 2000-04-30 House Journal Page 3677 HB 52 legislative branch, and the Legislative Council and the Legislative Budget and Audit Committee shall allocate the reduction among appropriations to the legislative branch. * Sec. 3. CONTINGENT EFFECT. (a) This Act does not take effect if the governor exercises the line item veto or line item reduction power to veto or reduce a provision contained in sec. 2 of this Act. (b) It is the intent of the legislature that, if this Act is not enacted as passed by the legislature, then this Act does not take effect." Renumber the following bill section accordingly. Representative Mulder moved and asked unanimous consent that Amendment No. 3 be adopted. Representative Berkowitz objected.
